Acceptance of terms

These Terms of Use govern your access to and use of the activTrac mobile application and related services. By downloading, accessing, or using activTrac, you agree to these Terms. If you do not agree, do not use the app.

Description of the service

activTrac is a mobile app that helps you track activities, routes, and achievements. activTrac offers a free tier supported by ads and an optional Premium subscription.

activTrac Premium currently includes the premium_monthly auto-renewing subscription, which provides an ad-free experience and access to premium features for the subscription period shown at the time of purchase.

Subscription terms

Premium subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Billing is handled through your Apple App Store or Google Play account.

The subscription price, billing period, and any applicable taxes are shown in the store interface at the time of purchase. Your account will be charged according to the store terms that apply to your purchase.

You can manage or cancel your subscription at any time through your Apple App Store or Google Play account subscription settings. Deleting the app does not cancel an active subscription.

Except where required by applicable law or by Apple App Store or Google Play policy, payments are non-refundable and we do not provide refunds or credits for partially used billing periods.

License grant and restrictions

Subject to your compliance with these Terms, activTrac grants you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, attempt to extract source code from, or create derivative works of activTrac except as permitted by applicable law.

User content and location data

activTrac may store activity, route, and location data locally on your device so that the app can provide its features. If you choose to export or share information, you are responsible for the content you share and for complying with applicable laws.

Disclaimer of warranties

activTrac is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that activTrac will be uninterrupted, error-free, secure, or that any stored information will always be available.

Limitation of liability

To the fullest extent permitted by law, activTrac and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenues, or business opportunities arising out of or related to your use of activTrac.

To the fullest extent permitted by law, the total liability of activTrac for any claim arising out of or relating to these Terms or the app will not exceed the amount you paid for activTrac Premium in the 12 months before the event giving rise to the claim, or US$10 if you have not made a purchase.

Termination

We may suspend or terminate your access to activTrac if you violate these Terms or if we discontinue the app. You may stop using activTrac at any time. Sections that by their nature should survive termination will continue to apply after termination.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we may provide notice by updating the date above or by other appropriate means. Your continued use of activTrac after updated Terms take effect means you accept the revised Terms.

Governing law
